Terms and Conditions for DeliveryEase App
Welcome to the DeliveryEase app (the "App"). By using our App, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before using the App.
Acceptance of Terms
By accessing or using the DeliveryEase App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use the App.
Eligibility
To use the App, you must be a DeliveryEase pharmacy customer, or an employee of a DeliveryEase pharmacy customer. By using the App, you represent and warrant that you meet this eligibility requirement.
User Accounts
- You may be required to create an account to access certain features of the App.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Services Offered
DeliveryEase provides a platform to facilitate the delivery of prescription medication and other products from pharmacies to customers. DeliveryEase is not responsible for the selection and preparation of medications, or any adverse reactions to medication received by customers.
User Responsibilities
- You agree to use the App only for lawful purposes and in compliance with all applicable Canadian laws and regulations, including but not limited to the Personal Information Protection and Electronic Documents Act (PIPEDA).
- You will not use the App to engage in any fraudulent, deceptive, or harmful activities.
- You agree to provide accurate and complete information when placing an order and to keep your account information up to date.
Payment Terms
All payments for services provided through the App are processed securely and in compliance with Canadian payment laws. By providing your payment information, you agree to pay all applicable fees and charges associated with your orders.
Data Protection and Privacy
We collect and process personal data in accordance with Canadian data protection laws, including PIPEDA and applicable provincial regulations. Your data will not be shared with third parties without your consent unless required by law.
Intellectual Property
All content, trademarks, and other intellectual property associated with the App are owned by DeliveryEase or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
Limitation of Liability
To the fullest extent permitted by Canadian law, DeliveryEase shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App or any services provided through the App. This includes but is not limited to loss of profits, loss of data, or business interruption.
Indemnification
You agree to indemnify and hold harmless DeliveryEase, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of your use of the App or violation of these Terms and Conditions.
Termination of Service
DeliveryEase reserves the right to suspend or terminate your account and access to the App at any time, without notice, for conduct that we believe violates these Terms and Conditions or applicable law, or is harmful to our interests or those of other users.
Changes to Terms
DeliveryEase reserves the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the updated terms in the App. Your continued use of the App after any changes constitutes your acceptance of the new terms.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in Toronto, Ontario for the resolution of any disputes.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Toronto, Ontario, in accordance with the Arbitration Act, 1991 (Ontario). The arbitration shall be conducted in English and the decision shall be final and binding.
